1. Terms and Conditions
1.1 General Overview
Please read these Terms and Conditions (“Terms”) carefully, as they govern your use of our platforms. These Terms outline your rights and obligations when using our services.
1.2 Company Information

1.3 Platform Operations
Nearide operates its web and mobile applications (“platforms”) under the brand name “Nearide,” connecting drivers with empty seats in their vehicles to passengers seeking rides.
1.4 Driver Responsibilities
Drivers must post their travel plans, including the departure point, stops, destination, start time, available seats, and seat cost.
1.5 Registration Requirement
To access Nearide’s services, users must register as members of the Nearide community.
1.6 Member Responsibility
By using Nearide platforms, passengers acknowledge that Nearide does not control the actions of its members.
1.7 Service Modification
Nearide reserves the right to cancel or modify certain services at its discretion, with notice to members.
1.8 Legal Agreement
By using the Nearide platforms, members agree to be legally bound by these Terms.
1.9 Terms Acceptance
Members who do not agree to these Terms may not use the Nearide platforms.
1.10 Updating the Terms
Nearide reserves the right to update these Terms at its discretion, with notice provided to members.
1.11 Continued Use
By continuing to use the platforms after changes are made, members agree to be bound by the updated Terms.
2. Diversity and Inclusion
2.1 Respectful Conduct
Nearide encourages all members to maintain a cordial and respectful attitude towards one another.
3. Becoming a Nearide Member
3.1 Membership Definition
A Nearide member is anyone who has opened and maintains an account on the Nearide platforms.
3.2 Eligibility
Members must be at least 16 years old and meet the legal requirements under Canadian law.
4. Fees and Payments
4.1 Payout Processing for Drivers
Upon successful completion of a ride, drivers will receive payouts for the seat fares collected from passengers. All payouts are processed in Canadian Dollars (CAD) through our integrated payment partners, Stripe and PayPal.
4.2 Deductions from Payouts
To facilitate secure and efficient transactions, the following deductions will be applied to each payout prior to disbursement to the driver:
- Payment Processor Fees: Stripe and PayPal will deduct 2.9% of the total payout amount, plus a flat fee of CAD $0.30 per transaction.
- Nearide Service Fee: Nearide will deduct 1% of the total payout amount to cover platform operations and maintenance.
- Referral Fee: An additional 1% of the total payout amount will be allocated to the referring member who introduced the paying passenger to the platform. In the event that no referring member is associated with the transaction, this 1% will be directed to the Nearide development team to support ongoing platform enhancements.
4.3 Transparency and Calculation
All fees are calculated transparently based on the gross fare amount collected from passengers. Drivers will receive a detailed breakdown of their payout, including itemized deductions, via the Nearide platform dashboard. Nearide reserves the right to adjust these fee structures with advance notice to members, in accordance with Section 1.10.
4.4 No Additional Charges
Except as outlined herein, no other fees will be charged by Nearide for standard payout processing. Members are responsible for any applicable taxes on their earnings, which will be reported in compliance with Canadian tax regulations.
4.5 Passenger Membership Fee
To access booking and ride reservation features on the Nearide platform, passengers are required to pay an annual membership fee of CAD $12.00, plus applicable taxes. This fee grants passengers the ability to book rides for a full calendar year from the date of payment. The fee is non-refundable and must be renewed annually to maintain booking privileges. Failure to renew the membership will result in restricted access to ride booking functionalities until payment is completed.
4.6 Passenger Fee Billing and Renewal
The annual membership fee will be billed upon initial registration as a passenger and whenever renewal is required, specifically at the time of booking a ride if the membership has expired or is due for renewal. Members will receive notification of the required payment during the booking process. All payments are processed securely through our payment partners, and applicable taxes will be calculated based on the member's location in accordance with Canadian tax laws.
